1. Business and acceptance
NYS Home Inspector is the website and DBA name used by Chen Chung Weng (Tony) for the services described on this site. By using the website or submitting a request, you agree to these terms and the Privacy Policy. If you do not agree, do not use the website.
2. Accounts and submitted information
You must provide accurate, current information and protect your login credentials. You are responsible for activity performed through your account and must notify us promptly if you suspect unauthorized access.
You represent that you are authorized to request services for the property and to provide the submitted address, occupant, access, photograph, report, and inspection information.
3. Requests, estimates, and scheduling
An online request is not an accepted appointment, final price, or guarantee of availability. Service is confirmed only after scope, access, timing, price, safety conditions, and any required agreement are accepted. Appointments may be rescheduled or declined when conditions are unsafe, inaccessible, outside the agreed scope, or legally restricted.
4. Home-inspection scope and limitations
A home inspection is a visual review of conditions and accessible areas within the agreed scope at the time of service. It is not technically exhaustive and is not a warranty that every defect, hazard, concealed condition, code issue, or future condition has been identified.
Areas or systems that are unsafe, inaccessible, concealed, obstructed, shut down, outside the agreement, or beyond a general home inspector’s scope may not be reviewed. The signed inspection agreement controls the final scope, exclusions, limitations, and client responsibilities.
5. Reports, photographs, and portal access
Reports and photographs are prepared for the requesting client and agreed purpose. Do not alter a report or present it as covering a different property, date, area, or scope. Portal access may be suspended to protect security, comply with law, or investigate misuse.
6. Communications and marketing
You agree to receive communications needed to respond to an inquiry, administer an account, schedule service, address safety issues, or deliver reports. Promotional communications are separate. Where required, they will be sent only after appropriate consent, and you may opt out without affecting your ability to purchase services.
7. Website availability and liability
The website may occasionally be unavailable or contain errors. To the maximum extent permitted by law, the website is provided as available, without warranties that it will be uninterrupted or error-free. Nothing in these terms excludes rights or liability that cannot legally be excluded. Any service-specific warranty, limitation, cancellation policy, or dispute term must be stated in the applicable written agreement.
8. Governing law and changes
These website terms are governed by New York law, without limiting any mandatory consumer rights. We may update them as services or legal requirements change. Continued use after revised terms are posted means you accept the revised website terms.
